1. Agreement

These terms apply when you use the FishyHam Studios website, apps or games (together, our "products"). They are an agreement between you and FishyHam Studios (Pty) Ltd, registration number 2026/758863/07 ("FishyHam Studios", "we", "us"). By using our products you agree to these terms. If you do not agree, please do not use them.

An app or game may have extra terms shown inside it or on its store page. If so, those extra terms apply to that product as well.

2. Using our products

You may use our products for your own personal, non-commercial use, in line with these terms, the law, and the rules of the store you got them from (such as Google Play or Steam).

Some products may need an account. If so, keep your login details safe and tell us if you think someone else is using your account.

3. Our content and intellectual property

The FishyHam Studios name, logo, website, apps, games, artwork, music, videos and code belong to us or our licensors and are protected by copyright and other laws. Using our products does not give you ownership of them.

You may share links to our website and short clips or screenshots of our games for non-commercial purposes such as reviews, streams and social posts, as long as you do not suggest we endorse you. For anything else, ask us first.

4. Your conduct

When using our products or our community spaces, you agree not to:

• break the law or infringe anyone else's rights;
• harass, threaten, impersonate or harm other people;
• cheat, exploit bugs to harm others, or interfere with how our products work;
• copy, reverse engineer or resell our products except where the law allows;
• upload anything harmful, such as malware.

Our communities on platforms such as Discord and Reddit also follow those platforms' own rules and any community rules we post there.

5. Purchases

Where a product is paid for, or offers in-app purchases, the purchase is processed by the store you use (for example Google Play or Steam), under that store's terms, including its refund policy. Your rights under the Consumer Protection Act, 2008, are not affected.

6. Availability and changes

We work hard to keep our products running, but we cannot promise they will always be available or free of bugs. We may update, change or stop offering a product or feature, usually with notice where that is reasonable.

7. Disclaimer

To the extent the law allows, our products are provided "as is" and "as available", without warranties of any kind, whether express or implied. Nothing in these terms limits any rights you have that cannot be excluded by law.

8. Limitation of liability

To the extent the law allows, FishyHam Studios is not liable for any indirect or consequential loss, or for loss of data, profits or opportunity, arising from your use of our products. Where we are liable, our total liability to you is limited to the amount you paid us for the product in question in the 12 months before the claim. This does not limit liability for gross negligence, fraud, or anything else that cannot be limited by law.

9. Ending your use

You can stop using our products at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if we are required to by law.

10. Law and disputes

These terms are governed by the laws of the Republic of South Africa. If a dispute arises, please contact us first so we can try to resolve it. Otherwise, the South African courts have jurisdiction.

11. Changes to these terms

We may update these terms from time to time. The date at the top shows when they were last updated. If you keep using our products after a change, the updated terms apply.
